According to Richard Cooper, State Chair, the OSCAR lawsuit would restore the protections of Article 8.10 limiting property taxes to 2% of the assessed valuation, rather than the full valuation it was changed in 1951 and that of Article 1.10 which prevented eviction of taxpayers from their land who missed or were late with a single tax payment.
Ray Mincone is the president of Melville-based OSCAR (the Organization of Senior Citizens and Retailers) and is now retired from an active business career as a president and consultant. OSCAR filed a class-action lawsuit alleging that without voter approval, the state removed several constitutional provisions that were specifically enacted to prevent property owners from being overtaxed. Mincone contends that this was illegal and unconstitutional. His appearance before the Libertarians does not mean that he or OSCAR endorses the Libertarians nor does it mean Libertarians endorse all of their positions. However, Libertarian State Chair Richard Cooper endorses the restoration of the homeowner protections under Articles 1.10 and 8.10 of the State Constitution. The Westbury business executive expects the Libertarian Party of New York to endorse a call to restore the provisions in the legislature rather than the court route taken by OSCAR and that Libertarian candidates will campaign to safeguard homeowners by restoring the protections of Articles 1.10 and 8.10 of the State Constitution.
